For bid proposals in the amount of $100,000.00 or more, the guarantee accompanying the bid proposals shall be given in the amount of 10% of the base bid, but not in excess of $20,000 unless required by law or regulation of the United States. The guarantee may be given at the option of the bidder by a Certified Check, Cashier's Check or a Bid Bond from a reputable company authorized to do business in New Jersey.
A Performance Bond in the amount of 100% of the contract price shall be required of the successful bidder. All bidders shall submit with their bids a Surety's Consent, from a surety company qualified to do business in the State of New Jersey or from an individual surety, stating that it will provide the contractor with such a Performance Bond within ten (10) days following the bid award resolution.
The contractor and all subcontractors shall comply with all applicable Local, State, and Federal non-discrimination, Equal Employment Opportunity and Affirmative Action requirements. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 to 38, P.L. 1975, C-127 and N.J.S.A 52:25-24.2, P.L. 1977, ch.-33, Section 1, and Executive Order 11246.
The contractor or subcontractors, where applicable, shall in all solicitations or advertisements for employees placed by or on behalf of the contractor, state that all qualified applicants shall receive consideration for employment without regard to age, race, creed, color, national origin, marital status or sex.
The contractor or subcontractors, where applicable, shall send to each labor union or representative or workers with which he has collective bargaining agreements or other contract or understanding, a notice, to be provided by the agency contracting officer, advising the labor union or worker's representative of the contractor's commitments under this act and shall post copies of the notice in conspicuous places available to employees and applicants for employment.
Any bid proposal submitted on behalf of a corporation or partnership must set forth below a list containing the names and addresses of all Stockholders and Partners owning a 10% or greater interest therein. This information is required pursuant to Chapter 33, Public Law 1977, and cannot be waived or cured after the receipt of bids. Failure to comply will result in the Rejection of the bid.
Bidders shall comply with the provisions of P.L. 2004, c.57 respecting the submission of a copy of the contractorโs and/or subcontractorโs business registration with the New Jersey Department of the Treasury, Division of Revenue, to be submitted at the time specified for the receipt of bids. The failure to submit such business registration shall be deemed a fatal defect that shall render the bid proposal unresponsive and that cannot be cured by the City of Englewood after the receipt of bids.
The City of Englewood reserves the right to reject any or all bids or waive any minor irregularity or non-compliance in the bids if in its judgment the public interest will be served by so doing. All bids shall be irrevocable, not subject to withdrawal and shall stand available for a period of sixty (60 days). Bids may be held by the City of Englewood for a period not to exceed sixty (60) days from the date of opening of bids for the purpose of reviewing the Bids and investigating the qualifications of Bidders, prior to awarding the Contract.
